About 3 years ago a new person bought our complex. Since then he has converted the storage units below my apartment into a shop for his company. He, on a regular basis is either working on diesel/gas powered equipment, painting or sandblasting, and welding/grinding different objects for his personal and company uses ( I have pictures). We have a 3 month old baby. I questioned him about the safety of these actions and his reply was "I should just close my windows when he is performing these actions. Another response was that he will give me a days notice when he will perform these tasks and I will be able to "vacate" the area until he is done"! My question, is it legal for him to perform these actions in a residential setting? He has no special "painting booths" or disposal means for the blasted materials. Do I have any recourse other than moving, which at this time will prove to be a financial hardship as I am laid off and my wife who works in the school system is off for the summer with no pay. Please respond soon as we had a discussion yesterday and I am expecting "static" from him about the situation. thank you

This one may be a little hard to fight. Areas of cities/towns are divided into commercial, residential, and industrial. This doesn't stop people from using their homes and/or other property for business purposes. I would check with your local zoning commision as well as look up local laws to see what recourse you might have. This gentleman is most likely covered under his insurance as well...there are many clauses that allow for him to work out of this "shop". I would also like for you to look at your lease. I'm sure there probably isn't a lot to go off of in this case, but I would bet that there is a clause concerning "quiet enjoyment". Read what this says and take it from there. I hope your local government will be able to help on this one.
