What are my options in court if tenant did not received eviction notice?
What are my options in court if tenant did not received eviction notice? The sheriff tried to deliver it but she was not eighter not home or she did not answer. On 12/15/09 I have to be in court. Off course she will be not there. The proper non payment notice was served. Please help and advice. Thank you.

Addition. I have sheriff delivered to her workplace. Somebody came and said that she is no longer employed with company. I called her work number and msg mashine picked it up saying her greetings, which means that she still works there and sheriff was lied about her unemployment. Should I address that in court and what would be an outcome? I will appreciate any help in this matter. Thanks. P

Wow. I wish that I could really help you. The best thing that you can do is just show up in court with you evidence. Here's what I would do. I would call her employer and ask them for their accounting/human resources number. When you call her employer, don't release her name because you may get in touch with someone that is close to her and they won't want to give any information out on her. The human resources department or accounting department should be able to tell you if she works there or not. To get information on my tenant, I called her employer and asked for their accounting firm. They gave me the number and I called and was able to get information about the employee. Good luck

I have a question that needs to be answered by Wednesday Dec. 16th. 2009 which my question is; Can my husband and I enter onto our property to take pictures of the inside of our house and the outside of our property without giving any notice to our tenants because they have not paid any rent to us since Sept. 2009?

It is ridiculus that lanlords have no help from anybody, such as forums, web pages, etc. If you look on the internet how to live in the house without paying and how to screw landlord, you will find hundred of pages of testimonials, advices, and personal experiences. If you look for help as a landlord you will find barlly any. No wonder landlords loose their cases. As an advice for HDBrown, I think you can go there to try to collect the payment and nobody was home so you entered and made few pictures as an inspection. I think you are entitled to inspect the property at least once a month. I have no legal experience but what I just daid makes sense. Good luck. P

You can always ask the Judge to postpone the case so you can get the tenant served properly. In some states this is called an "alias summons". - Jeremy Piper, Attorney
